ส่วนที่ 5 - การจัดส่งและการส่งมอบ

ส่วนที่ 7 - เครื่องมือเสริม (ไม่บังคับ)
คุณอาจได้รับสิทธิ์เข้าถึงเครื่องมือสำหรับลูกค้าที่ผู้ให้บริการภายนอกจัดหาให้ ซึ่งเป็นส่วนหนึ่งของบริการ โดยเราไม่ได้ตรวจสอบ และไม่มีอำนาจควบคุมหรือมีส่วนเกี่ยวข้องกับเครื่องมือดังกล่าว

ส่วนที่ 12 - ข้อผิดพลาด ความคลาดเคลื่อน และการตกหล่น
ในบางครั้ง อาจมีข้อมูลบนหรือภายในบริการที่มีข้อผิดพลาดทางการพิมพ์ ความคลาดเคลื่อน หรือการตกหล่นของข้อมูล ซึ่งอาจเกี่ยวข้องกับคำอธิบายสินค้า ราคา โปรโมชัน ข้อเสนอ ค่าจัดส่งสินค้า ระยะเวลาการขนส่ง และความพร้อมจำหน่าย เราขอสงวนสิทธิ์ในการแก้ไขข้อผิดพลาด ความคลาดเคลื่อน หรือการตกหล่นของข้อมูล รวมถึงการเปลี่ยนแปลงหรืออัปเดตข้อมูล หรือยกเลิกคำสั่งซื้อ หากพบว่าข้อมูลใดๆ ไม่ถูกต้องไม่ว่าในเวลาใดก็ตาม โดยไม่ต้องแจ้งให้ทราบล่วงหน้า (รวมถึงภายหลังจากที่คุณส่งคำสั่งซื้อแล้ว)

ส่วนที่ 13 - การใช้งานที่ต้องห้าม

นอกจากนี้ คุณตกลงว่าจะไม่: (a) อัปโหลดหรือส่งไวรัส หรือโค้ดที่เป็นอันตรายประเภทอื่นใด ซึ่งจะหรืออาจถูกนำไปใช้ในลักษณะที่ส่งผลกระทบต่อฟังก์ชันการทำงานหรือการดำเนินงานของบริการ (b) ทำซ้ำ ทำสำเนา คัดลอก ดึงข้อมูล ขาย ขายต่อ หรือแสวงหาประโยชน์จากส่วนใดส่วนหนึ่งของบริการ (c) รวบรวม หรือติดตามข้อมูลส่วนบุคคลของผู้อื่น(d) ส่งสแปม ทำฟิชชิ่ง ทำฟาร์มมิ่ง หรือแอบอ้างหลอกลวงในการใช้บริการ (e) ใช้โรบอท สไปเดอร์ เครื่องมือดึงข้อมูล เครื่องมือรวบรวมและสกัดข้อมูล อุปกรณ์หรือกระบวนการอัตโนมัติ เครื่องมือ AI (เช่น Agentic AI) หรือวิธีการอัตโนมัติหรือวิธีการด้วยตนเอง เพื่อเข้าถึงบริการ หรือ (f) แทรกแซง หลบเลี่ยง หรือหลีกเลี่ยงมาตรการด้านความปลอดภัยหรือฟีเจอร์การอนุญาต การจำกัดการเข้าถึงของหุ่นยนต์ หรือมาตรการอื่นใดที่เราใช้เพื่อจำกัดการเข้าถึงบริการ เราขอสงวนสิทธิ์ในการระงับ ปิดใช้งาน หรือยกเลิกบัญชีของคุณได้ตลอดเวลา โดยไม่ต้องแจ้งให้ทราบ หากเราพิจารณาแล้วว่าคุณฝ่าฝืนข้อใดข้อหนึ่งของข้อกำหนดเหล่านี้

ส่วนที่ 14 - เอเจนต์

14.2 ห้ามเอเจนต์เข้าถึง ใช้ หรือโต้ตอบกับบริการ เว้นแต่จะยืนยันตัวตนและดำเนินการอย่างเคร่งครัดตามข้อกำหนดในหัวข้อ 14.4 ด้านล่างตลอดเวลา นอกจากนี้ ยังห้ามเอเจนต์เข้าถึง ใช้ หรือโต้ตอบกับบริการ หากเราได้ขอให้เอเจนต์งดเว้นจากการเข้าถึง ใช้ หรือโต้ตอบกับบริการใดๆ แล้ว
14.3 เราอาจจำกัด (รวมถึงโดยมาตรการทางเทคนิค) ว่าให้เอเจนต์ใดๆ เข้าถึง ใช้ และโต้ตอบกับบริการได้หรือไม่ และในลักษณะใด

ส่วนที่ 15 - การสิ้นสุด
เราอาจสิ้นสุดข้อตกลงนี้หรือยุติการเข้าถึงบริการของคุณ (หรือส่วนใดส่วนหนึ่งของบริการ) ได้ตามดุลยพินิจของเราแต่เพียงผู้เดียวไม่ว่าเมื่อใดก็ตามโดยไม่ต้องแจ้งให้ทราบ และคุณจะยังคงต้องรับผิดต่อจำนวนเงินทั้งหมดที่ถึงกำหนดชำระจนถึงและรวมถึงวันที่มีการสิ้นสุดนั้น

ส่วนที่ 16 - การปฏิเสธการรับประกัน

ส่วนที่ 18 - การชดใช้ค่าเสียหาย
คุณตกลงที่จะชดใช้ค่าเสียหาย ปกป้อง และทำให้ Sabaiflow, Shopify รวมถึงบริษัทในเครือ พาร์ทเนอร์ เจ้าหน้าที่ กรรมการบริษัท พนักงาน ตัวแทน ผู้รับจ้าง ผู้อนุญาตให้ใช้สิทธิ์ และผู้ให้บริการของเรา พ้นจากความรับผิดจากความสูญเสีย ความเสียหาย หรือการเรียกร้องใดๆ รวมถึงค่าทนายความตามสมควร ที่ต้องชำระให้แก่บุคคลอื่น อันเนื่องมาจากหรือเกิดขึ้นจาก (1) การฝ่าฝืนข้อกำหนดในการใช้บริการเหล่านี้หรือเอกสารรวมไว้เพื่ออ้างอิง (2) การละเมิดกฎหมายหรือสิทธิ์ของบุคคลอื่น หรือ (3) การเข้าถึงและการใช้บริการของคุณ

ส่วนที่ 19 - การแยกออกจากกันได้ของข้อกำหนด
ในกรณีที่บทบัญญัติใดๆ ของข้อกำหนดในการใช้บริการเหล่านี้ถูกพิจารณาว่าไม่ชอบด้วยกฎหมาย เป็นโมฆะ หรือไม่อาจบังคับใช้ได้ บทบัญญัติดังกล่าวจะยังคงถูกบังคับใช้ได้ในขอบเขตสูงสุดเท่าที่กฎหมายที่ใช้บังคับอนุญาต และส่วนที่ไม่อาจบังคับใช้ได้นั้นให้ถือว่าแยกออกจากข้อกำหนดในการใช้บริการเหล่านี้ โดยการพิจารณาดังกล่าวจะไม่กระทบต่อความถูกต้องและการบังคับใช้ของบทบัญญัติอื่นใดที่ยังคงมีผลอยู่

ส่วนที่ 21 - การโอนสิทธิ์
